3. OBJECT AND SCOPE OF APPLICATION

3.1. These General Terms and Conditions of Sale exclusively govern purchases made through BONDER™’s online store, between the End Consumer as the buyer and Bonder Lda as the seller, and apply to all visitors of the site www.bonderandco.com, as well as to any commercial transactions conducted through this online store.

3.2. Browsing the site and purchasing any product on www.bonderandco.com implies acceptance of these general conditions of use and contracting.

3.3. Bonder Lda markets all BONDER™ products and is responsible for selling the brand’s items on www.bonderandco.com.

3.4. An End Consumer or User or Buyer is any person who acts/purchases with a personal purpose, unrelated to their business or profession, and without any intention to resell the items purchased from the BONDER™ online store.

3.5. Bonder Lda reserves the right to amend these terms of use and contracting without prior notice, as well as to modify at any time the information and commercial offerings presented regarding products, prices, promotions, commercial conditions, and services. Any changes will always be published on the website www.bonderandco.com.

3.6. Bonder Lda reserves the right not to process any order received from users who do not agree with the General Terms of Sale.

3.7. The End Consumer must provide Bonder Lda, as the seller, with a correct and complete email or postal address or other contact details and accepts that Bonder Lda may contact them using this information if necessary.

4. INFORMATION ON BONDER™ ONLINE STORE CONTENT

4.1. The site www.bonderandco.com is intended for personal use only, and reproduction, transfer, distribution, or storage of its content for any purpose other than personal use without prior written authorization is strictly prohibited.

4.2. It is strictly prohibited to insert links to our site for commercial purposes or without prior authorization from Bonder Lda, as well as to use the domain www.bonderandco.com abusively. Legal action may be taken if necessary.

4.3. If you find links that grant access to www.bonderandco.com on other websites or references to the BONDER™ online store, please be aware that Bonder Lda is not responsible for the links, pages, or their content.

4.4. We are committed to ensuring that the information presented on www.bonderandco.com is free of typographical errors and will correct any errors as soon as possible when detected.

4.5. All contractual information is written in Portuguese, as well as product information, emails, and formal sale documents, except for specific expressions from the fashion industry.

5. COMMERCIAL POLICY

5.1. If the presented information does not match the product’s characteristics, the Client has the right to cancel the purchase agreement under applicable law.

5.2. The photos on the website are illustrative. Please carefully consult the product details for more information on the characteristics of the articles you wish to purchase.

5.3. Product prices and specifications are subject to change without prior notice. Despite BONDER™’s best efforts to keep all information updated, some products may have incorrect pricing. Prices will be verified when orders are processed. If the product price is lower than the stated price, we will refund the difference. If higher, we will notify the End Consumer by email to accept the new price or cancel the order.

5.4. The BONDER™ online store is independent of physical stores in terms of prices, products, and stock levels. All promotional campaigns have limited stock and are exclusive to the BONDER™ online store.

5.5. Validating an order implies that the Buyer has read and accepted the General Terms and Conditions of Sale available at www.bonderandco.com.

5.6. All data recorded by Bonder Lda constitutes proof of the transactions between the Seller and the End Consumer, and Bonder Lda is responsible for archiving the electronic document formalizing the contract and ensuring its accessibility.

6. CUSTOMER AND USER OBLIGATIONS

6.1. Any visitor to www.bonderandco.com must comply with these general conditions, specifically:

It is forbidden to insert, store, or disseminate defamatory, obscene, offensive, xenophobic, or unlawful content through the BONDER™ site;

Keep your login password secure and do not share it to prevent third-party access to your account;

Do not use false identities;

Provide accurate personal data and addresses so that Bonder Lda can process orders correctly.

6.2. The End Consumer is solely responsible for the accuracy of the personal data provided to Bonder Lda and agrees to update any changes through their registered account at www.bonderandco.com.

6.3. Bonder Lda is not responsible for delays or failure to process an order due to incorrect or insufficient data provided by the End Consumer, particularly at the delivery stage.

7. PRODUCT AVAILABILITY AND ORDER CONFIRMATION/CANCELLATION

7.1. Bonder Lda only processes orders after payment confirmation and cannot guarantee availability until processing begins.

7.2. The order confirmation will show an estimated shipping date after payment confirmation, which may vary depending on the shipping carrier and destination.

7.3. Orders are shipped only on business days. Weekends and public holidays are not included in delivery estimates. Shipping delays do not entitle the customer to compensation.

7.4. All orders are subject to product availability. Bonder Lda reserves the right to cancel confirmed orders for out-of-stock items. In such cases, the customer will be informed and refunded accordingly.

7.5. Products not in stock are made to order. Therefore, Bonder Lda reserves the right NOT to cancel these purchases.

8. ORDER CONFIRMATION OR CANCELLATION

8.1. Bonder Lda may reject orders if payment is not guaranteed, if the order is incomplete or incorrect, or if the products are no longer available. The customer will be notified via email.

8.2. If the products ordered are no longer available at the time of order receipt, the User will be informed within 30 days of the request.

8.3. If payment has been made for unavailable products, Bonder Lda will refund the amount paid.

8.4. Bonder Lda reserves the right to cancel any order for reasons such as:

• Incorrect or unverifiable invoice data;
• Orders flagged by the website’s security systems;
• Non-receipt of payment within two business days;
• Inability to deliver to the address provided;
• Buyer lacks legal capacity to purchase;
• Errors in the presentation of product prices.

9. PAYMENT CONDITIONS AND SECURITY GUARANTEES

9.1. Available payment methods are listed at www.bonderandco.com. No other methods are accepted.

9.2. Payments may be made via credit card, EASYPAY system, PayPal, or bank transfer (IBAN provided at checkout).

9.3. Credit card data is encrypted and processed by EASYPAY. Bonder Lda does not store or use this data except for refunds or fraud reporting.

9.4. The total purchase price, including shipping, will be charged upon product dispatch.

9.5. Do not attempt to pay using any method not listed. Bonder Lda is not responsible for lost payments or damages from such attempts.

10. ONLINE STORE SECURITY AND TRANSACTIONS

10.1. BONDER™’s store uses advanced encryption for payment information, ensuring it is not stored on public servers.

10.2. Despite robust encryption, electronic transactions carry risks if the User does not follow responsible conduct.

10.3. Bonder Lda is not liable for damages from electronic communication issues, such as delays, interceptions, or malware.

11. RETENTION OF TITLE

Bonder Lda retains ownership of all products until full payment is received.

12. PRICES

12.1. All product prices on www.bonderandco.com include VAT.

12.2. Final prices include taxes and shipping. Always transfer the exact amount specified and for each order individually.

12.3. Shipping fees are calculated per order and vary by city and country.

12.4. Prices are displayed in USD and EUR. Changing the delivery country may affect prices due to shipping costs.

13. QUALITY AND WARRANTY

13.1. Bonder Lda only sells high-quality products on www.bonderandco.com and will never offer second-hand items, defective goods, or products below BONDER™’s high quality standards.

13.2. The products available on www.bonderandco.com may not exactly match their images and colors due to the web browser and monitor used.

14. SHIPPING AND DELIVERY

14.1. Products ordered from the BONDER™ online store are shipped and delivered on business days, from Monday to Friday.

14.2. We can only guarantee successful delivery if the shipping address is correctly provided and located in one of the countries listed in our “Deliveries” section.

14.3. A delivery is considered completed when the customer signs the delivery receipt at the agreed address.

15. SHIPPING COSTS AND DELIVERY DEADLINES

Shipping costs are billed per order. If you order more than one item, shipping is charged only once. However, Bonder Lda reserves the right to split the delivery if, for example, part of the order is delayed or unavailable. If we split the order, the customer will be notified via the email provided at checkout.

16. DELIVERY TIMES

16.1. Once your order is registered and payment confirmed, and if all items are available, Bonder Lda commits to shipping the order within the following timeframe:

• Orders are delivered within 8 to 15 business days, except for made-to-order products, which have a delivery time of up to 40 business days.
• Deliveries to countries deemed complex or hard to access by BONDER™ will be assessed on a case-by-case basis, and the customer will be informed accordingly.

16.2. Bonder Lda is not responsible for delays or failure to fulfill shipping obligations due to force majeure events beyond its reasonable control.

17. GOVERNING LAW

17.1. These Terms and Conditions and any disputes related to them, including their validity, use of the site www.bonderandco.com, or purchases made on it, are governed by Portuguese law.

17.2. In case of a dispute regarding the interpretation or execution of these Terms and Conditions, Bonder Lda and the Buyer commit to seeking an amicable, fair, and adequate solution within 60 (sixty) days of receiving the related communication from either party.

17.3. If no amicable solution is reached, both parties agree to submit to the jurisdiction of the Lisbon Civil Court, expressly waiving any other jurisdiction.

18. AMENDMENTS TO THE TERMS AND CONDITIONS OF THE BONDER ONLINE STORE

Bonder Lda reserves the right to amend these Terms and Conditions at any time. The Buyer is subject to the terms and conditions in effect at the time of their order, unless legal or regulatory changes require otherwise.
